Public Offer and Terms of Use

1. Status and Scope of the Offer

The Offer is addressed to adult individuals with full legal capacity and to representatives of organisations who have authority to place an order. It applies to orders made on bslimousine.kz where LLP “ICBP” is identified as the contracting party and payment recipient.

The published text without generated order-specific terms and a final price forms the general part of the Offer. A specific order can be accepted only after the complete checkout is displayed and the final payment button is active.

A new version applies only to future acceptances. A contract already concluded remains governed by the version recorded when the order was placed.

3. Key Definitions and Parties

ICBP means LLP “ICBP”, which accepts an order in its own name, is the party to the contract with the customer and receives payment.

Customer means the person who creates, accepts and pays for an order. Passenger means the person for whom the trip is arranged; the customer and passenger may be different persons.

Carrier means an independent local contractor that is a legal entity or individual entrepreneur and performs the actual transportation with the necessary permits, vehicle, driver and insurance.

Order-Specific Terms means the immutable record of the parameters of a particular order shown before acceptance. Order Confirmation means an electronic message containing the order number and the accepted versions of the documents; it evidences a contract that has already been concluded and does not postpone contract formation to a later moment.

4. Subject of the Contract and Allocation of Roles

For the agreed final price, ICBP undertakes to register the order, record its parameters, select and appoint a carrier, arrange the trip, notifications and support, implement agreed changes, replace the contractor where necessary and process refunds.

The actual transportation is performed by the carrier. Its name and contact details are provided to the customer before the trip. The carrier is responsible for the legality and safety of transportation, permits, insurance, technical condition of the vehicle and actions of the driver. ICBP is responsible for its own contractual obligations, including price, booking, appointment, support, payments and refunds.

The service operates on a pre-booked basis and is not a street-hail service, emergency service or promise of immediate vehicle dispatch.

5. Order-Specific Terms Before Acceptance

Before payment, the customer is provided at least with:

• the contracting entity and payment recipient;
• the route, hourly period or other scope of service;
• local date and time, pickup point and destination where applicable;
• vehicle class and capacity, number of passengers, luggage and confirmed special services;
• final price and currency, and known mandatory taxes and charges;
• included waiting time, no-show rule and cancellation terms;
• possible additional charges with a tariff, formula or maximum amount;
• the validity period of the price offer and the applicable version of the documents.

The customer must review this information before acceptance. Correcting parameters before pressing the final button does not constitute a change to an already concluded contract. After the stated price validity period expires, checkout must request a new calculation and must not accept payment under the expired price offer.

6. Acceptance and the Exact Moment of Contract Formation

Acceptance must be complete and unconditional. Silence, viewing a page, completing a draft form, pressing a price-calculation button or an unsuccessful payment attempt do not constitute acceptance.

To accept the Offer, the customer performs the following steps in sequence:

• selects a checkbox that is not pre-selected to accept this Public Offer and the Order-Specific Terms;
• separately gives the required consent to the collection and processing of personal data;
• presses the final button “Pay [final amount] KZT and conclude the contract”;
• completes payment authentication, after which the ICBP system receives and records a successful payment authorisation status for the order.

The contract is deemed concluded and signed by the parties in electronic form on the date and at the time when the ICBP information system records successful payment authorisation performed after the customer has completed the actions above.

That record, rather than a later email, appointment of a carrier or commencement of the trip, is the moment when the contract is concluded. ICBP sends the Order Confirmation without undue delay; non-delivery or delayed delivery of the email does not change the moment of contract formation.

The parties agree to use electronic form. The order record links the identity and contact details of the customer, order parameters, amount, payment status, date and time, IP address, session identifier, checkbox text, URL, version and checksum of the Offer. Together, these elements record the parties and the content of their declarations of intent. This record is not declared to be an electronic digital signature and does not require an EDS unless an EDS is mandatorily required by law for the particular case.

If the ICBP system does not receive and record a successful status, the contract is not concluded. Any erroneous hold or debit in such a case is cancelled or refunded in full to the original payment instrument.

7. Price, Payment and Fiscal Document

Pricing rules are set out on the Prices page. Before acceptance, the customer sees one final amount and currency, the included services and all known mandatory payments.

Payment recipient: LLP “ICBP”. Bank details of ICBP: JSC “Bank CenterCredit”, IBAN KZ278562203158069913 (account currency KZT); BIC (SWIFT) KCJBKZKX. The transaction description on a bank statement is generated in the form agreed with the acquirer; the contracting entity shown at checkout and in the Order Confirmation must remain the same.

All payments made through website acquiring are processed exclusively in Kazakhstani tenge (KZT).

Foreign companies may pay for services in United States dollars (USD) or euros (EUR) by SWIFT transfer to the settlement account of LLP “ICBP” against a separately issued invoice. The currency, amount, payment deadline and allocation of bank charges are agreed in the contract and/⁠or invoice. This payment arrangement is separate and is not processed through website acquiring.

Checkout displays only payment methods that are actually connected. Subject to confirmation by the acquirer, these may include Visa, Mastercard, American Express, UnionPay, Apple Pay and Google Pay.

Card details are entered on the secure page of the bank or payment provider or in a wallet interface. ICBP does not receive or store the full card number, CVV/⁠CVC, PIN or one-time banking code. The bank, payment system, Apple and Google are not the seller or the carrier. A fiscal document is provided in accordance with the legislation of the Republic of Kazakhstan.

8. Order Registration, Appointment and Performance

The Order Confirmation contains the number, route, date and time, class, price, currency, waiting time, cancellation terms, payment status and accepted versions of the documents. A specific carrier may be appointed after the contract is concluded and this appointment is not an additional condition for validity of the contract.

If ICBP cannot appoint a carrier within the promised period, the customer may agree to a documented extension, accept an equivalent replacement or demand a full refund.

The order relates to the class, capacity and confirmed characteristics of the vehicle, not to a specific model or driver unless a model is expressly guaranteed. An equivalent or higher class may be provided at no additional charge. A lower class may be provided only with customer consent and a proportionate reduction in price.

The pickup point, free waiting period and no-show rule are shown before acceptance. A no-show is recorded only after the disclosed waiting period has expired and reasonable documented attempts have been made to contact the customer or passenger.

9. Obligations of the Customer and Passenger

The customer and passenger must provide accurate information, review the Order-Specific Terms, arrive at the pickup point, remain reachable through the contact details provided, use seat belts and any required child restraint systems, comply with lawful driver instructions, refrain from carrying prohibited or dangerous items and avoid creating a safety risk.

The customer is responsible for keeping access to the customer account confidential and must promptly report suspected unauthorised use. Fraudulent orders, interference with website operation, circumvention of payment protection and use of automation that creates excessive load or infringes the rights of others are prohibited.

The number of passengers and amount of luggage must not exceed the confirmed capacity. A child seat, accessible vehicle, transportation of an animal, oversized or unusual luggage, meet-and-greet sign and other special services form part of the order only after written confirmation from ICBP.

The carrier may refuse to start or continue the trip if performance would be unlawful or unsafe, capacity is exceeded or a passenger creates an immediate threat. Financial consequences are determined by law, the circumstances and documented costs, not by automatic retention of the entire price.

10. Changes and Additional Charges

A change to the route, date, time, class, duration, passengers, luggage or special services takes effect after confirmation by ICBP.

If a change affects the price, the customer receives a new final amount or a clear calculation in advance and separately confirms the change. Silence does not constitute consent. Hidden, unlimited or unconfirmed additional charges do not apply.

The driver may not demand a second cash payment for the included scope of service. Tips are voluntary.

11. Cancellation, No-Show and Refunds

An order may be cancelled through the booking management function or by sending a message to info@bslimousine.kz or Telegram @bslimousine. For urgent contact, call +7 702 910 1628. The specific free-cancellation deadline and consequences of late cancellation are shown before acceptance.

If the customer cancels, only actual, documented and legally permissible costs directly related to the order may be retained. The entire amount is not retained automatically.

If ICBP does not appoint a carrier by the promised deadline, cancels the service for a reason not attributable to the customer, or the service is not provided, a full refund is made. If the service is partly performed, the price of the unperformed part is refunded.

A refund is initiated to the original payment instrument without undue delay and, as a rule, no later than five business days after entitlement to the refund is confirmed. The actual crediting time depends on the issuing bank and payment system.

12. Safety, Liability and Force Majeure

ICBP is responsible for its own contractual obligations. The carrier is responsible for the vehicle, driver and actual transportation. Mandatory consumer rights and liability for intentional misconduct, gross negligence and harm to life or health are not excluded or limited.

A party is liable for proven direct losses to the extent established by law and causation. Nothing in this Offer transfers the business risk of ICBP or the carrier to the consumer.

In extraordinary and unavoidable circumstances, the rules of the legislation of the Republic of Kazakhstan apply. An ordinary traffic jam, malfunction of a particular vehicle, absence of a replacement driver or shortage of internal resources do not in themselves constitute force majeure.

13. Personal Data

Personal data processing is governed by the Privacy Policy and the separate Consent to the Collection and Processing of Personal Data. Data consent is not combined with acceptance of the Offer, and marketing consent is optional and disabled by default.

If the customer books for another passenger, the customer confirms a lawful basis and authority to transfer that passenger data and must inform the passenger of the applicable processing terms. Where necessary, ICBP requests direct consent from the passenger.

14. Claims, Governing Law and Evidence

Claims are accepted electronically at info@bslimousine.kz. Support is also available by phone at +7 702 910 1628 and through Telegram @bslimousine. It is recommended that a claim include the order number, circumstances and requested remedy, but a full card number or CVV/⁠CVC must not be provided.

If ICBP disagrees with a consumer claim, ICBP sends a reasoned written response with supporting documents within ten calendar days after receiving the claim. The consumer may apply to the competent authority, an out-of-court dispute resolution entity or a court. Information is available on the official consumer protection portal.

The law of the Republic of Kazakhstan applies without limiting mandatory consumer rights. The place of contract formation is the location of ICBP unless a mandatory rule provides otherwise.

ICBP retains the order number, Order-Specific Terms, record of customer actions, payment status, date, time, language, URL, version and checksum of the applicable Offer. The customer may request a copy of the accepted version at info@bslimousine.kz.
